All appeals by the Defendants are dismissed.
Reasons
1. The summary of the grounds for appeal (unfair sentencing) of the lower court’s punishment against the Defendants (an administrative fine of KRW 5 million) is too unreasonable.
2. The Defendants recognized the instant crime and against the mistake, Defendant B had no record of criminal punishment before, Defendant A had no record of criminal punishment for the same crime before, and the Defendants would not repeat the same mistake again.
It is hard to say that there is a favorable circumstance for the defendants.
On the other hand, the crime of this case is committed in collusion with the defendants, which prevents the employment of new employees by deceiving the head of the DNA federation as if they were employed as employees through an open competitive recruitment examination. The defendants actively altered and submitted documents, such as the resume submitted by I, etc. during the process of interference with the above business, and did not receive a letter from the injured party of the crime of interference with the business until the depth of the case.
In full view of the above circumstances and other factors of sentencing as indicated in the records and arguments of the instant case, such as the background of the instant crime, the age of the Defendants, sexual conduct, environment, etc., the lower court’s punishment against the Defendants is too unreasonable, and thus, the Defendants’ assertion is without merit.
3. In conclusion, the Defendants’ appeal is without merit, and all of them are dismissed pursuant to Article 364(4) of the Criminal Procedure Act, and it is so decided as per Disposition (Provided, That the judgment of the court below is clearly erroneous in the judgment of the court below, each of the three pages 5, 6-7, 9, 17-18, and 3-4, 5, 13-14, 19-20 of the part 2 pages 3-4, 3-4, 5, 13-14, 19-20 of the judgment of the court below, and the "D previous North Korean branch" is a clerical error in the "D previous North Korean branch" of each "D previous North Korea branch".
