A defendant shall be punished by imprisonment for two years.
Reasons
Punishment of the crime
[criminal history] On November 27, 2008, the Defendant was sentenced to a fine of KRW 4.6 million for a violation of the Act on the Exercise of Sovereign Rights on Foreign Fishing, etc. in the Exclusive Economic Area by the Incheon District Court, and a fine of KRW 120 million for a violation of the Territorial Sea and Contiguous Zone Act in the same court on November 26, 2012.
[2] The Defendant, as a Chinese citizen, is a captain in charge of the operation and fishery activities of C (a 25 ton vessel, hereinafter “the above vessel”), a fishing vessel with a genetic ship at the same time and at the same time.
A foreign vessel may navigate in the territorial sea of the Republic of Korea without prejudice to peace, public order or security of the Republic of Korea, to the extent that such navigation does not impair peace, public order or security of the Republic of Korea, and when a foreign vessel engages in fishing at the time of passage, it shall be deemed to impair peace, public order or security of the Republic of Korea, and no crew member of a foreign vessel or other passenger shall violate such prohibition
Nevertheless, the Defendant, at around 01:00 on June 2, 2016, went into the Republic of Korea, on board three other seafarers on board the vessel specified in paragraph (1) of the same paragraph of the same paragraph of the same paragraph, and went into the Republic of Korea to operate his/her own net fishing gear, and on June 4, 2016, at approximately 0.2 nautical miles (or 37:41 minutes above, 125: 41 minutes east, east-do, Incheon, in which the territorial sea of the Republic of Korea was over 13 nautical miles (or 40 minutes below, e.g., 22:00 east-do 15 nautical miles, east-do 400 east-do east-do east-do 15 east-do east-do east-do 15 east-do east-do 25 east-do east-do 125 east-do 410 east east-25 east.
