A defendant shall be punished by imprisonment for three years.

Punishment of the crime

On December 7, 2012, the Defendant was sentenced to three years of imprisonment due to forced indecent acts, etc. committed by the Seoul High Court, and completed the execution of the sentence in Daejeon Prison on February 2, 2015.

[Criminal facts] Around September 2015, the Defendant had frequently visited the victim’s residence in Seo-gu, Daejeon, as well as the victim’s relationship with the victim B around September 2015.

1. On September 21, 2015, the Defendant: (a) around 11:30 on September 21, 2015, at the victim B’s house located inside the victim’s residence; (b) held each of the D credit cards owned by the victim’s victim’s wall; (c) one E credit card; and (d) one F credit card.

Accordingly, the defendant stolen the victim's property.

2. On September 21, 2015, the Defendant in violation of the Act on Financial Business Specializing in thief and credit finance at H branches located in Seo-gu Daejeon, Daejeon, on September 12:38, 2015, collected DNA credit cards in the name of B, as described in paragraph (1), and withdrawn KRW 700,000 in cash by inputting the password of the said card, which was known in advance, from the cash withdrawal period managed by the victim H, as stated in paragraph (1) above.

In addition, from that time until 13:49 of the same month, the Defendant released cash by using three credit cards in the name of B, as described in attached Table 1, in total, 14 times, as shown in attached Table 1.

Accordingly, the defendant stolen the victims' property and used stolen credit cards.

3. Violation of Acts in financial business specializing in fraud and credit finance;

A. On September 26, 2015, around 23:31, the Defendant was provided with food equivalent to KRW 350,000 from the victim who was unable to know his/her name, and paid the price by using the credit card in the name of B, as described in paragraph (1) above.

B. On October 1, 2015, the Defendant provided food equivalent to KRW 170,000,00 from a person who was unable to know his/her name, at a restaurant “LA restaurant” on the second floor of Seo-gu Daejeon Daejeon, Seo-gu, Daejeon, with food around 00:34.
