1. The Plaintiff:
A. Defendant A and B jointly and severally share KRW 3,128,381 and KRW 2,577,502 among them.
Reasons
Description of Claim
Hyundai Capital Co., Ltd. (hereinafter referred to as "Moman Capital Co., Ltd.") filed a lawsuit against Defendant A Co., Ltd. (hereinafter referred to as the "Defendant Co., Ltd.") and Defendant B with the Daejeon District Court Decision 2005Gau2484, which decided on August 26, 2005 that "the defendant jointly and severally paid to the plaintiff 5,533,392 won and 5,391,584 won from May 14, 2005 to August 12, 2005, the amount of 24% per annum from August 13, 2005 to the day of full payment," and the above judgment became final and conclusive on September 10, 2005.
The remaining balance of the principal debt of the Defendants as of February 28, 2015 is KRW 2,577,502, and the interest accrued from March 1, 2015 to November 24, 2015 is KRW 550,879.
(Total 3,128,381 won. The Korea Technology Credit Guarantee Fund of the Korea Technology Credit Guarantee Fund filed a lawsuit against the Defendants with the Daejeon District Court 2005Kadan48175. On January 10, 2006, the said court sentenced the said court to the effect that “The defendants jointly and severally pay to the Plaintiff the amount of KRW 87,027,931 and 87,027,871 per annum from September 7, 2005 to December 27, 2005, and the amount of KRW 20% per annum from the following day to the date of full payment.” The said judgment became final and conclusive on February 10, 2006.
The Defendants’ balance of the debt principal as of June 30, 2012 (=29,257,644 won 54,504,794 won) is KRW 38,021,260 for overdue interest from July 1, 2012 to November 24, 2015 (=5,335,311 won) 7,945,253 won 9,939,285 won 14,801,411 won)
(Total 121,783,698). The Credit Guarantee Fund of the Korea Credit Guarantee Fund filed a lawsuit against the Defendants with the Daejeon District Court 2006Gahap634, and the Defendants jointly and severally from the above court on March 30, 2006 with the Plaintiff for KRW 224,157,319 and KRW 221,769,359 from August 11, 2005 to February 3, 2006.
