1. The defendants are 800,000,000 won to each plaintiff and 5% per annum from November 25, 2005 to September 6, 2006.
Reasons
1. Indication of claim;
A. On October 9, 2006, the Plaintiff filed a lawsuit against the Defendants with Daejeon District Court 2006Gahap3053, and sentenced the said court to the effect that “the Defendants shall pay to each of the Defendants 800,000,000 won with 5% interest per annum from November 25, 2005 to September 6, 2006, and 20% interest per annum from the next day to the day of full payment.” This judgment became final and conclusive around that time.
B. The Plaintiff filed the instant lawsuit to extend extinctive prescription.
2. Judgment by public notice (Article 208 (3) 3 of the Civil Procedure Act).
3. The statutory interest rate was amended by Presidential Decree No. 26553 on September 25, 2015 by Article 3(1) main sentence of Article 3(1) of the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings on Part of Dismissal.
