A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
Around November 2016, the Defendant accepted a proposal that “I will pay KRW 100,000 per case when I enter the name of the party in the name of the legal entity in the form of the agent column and opened the legal entity account in the name of the party,” which was known at the Internet “B” website (one named “C”).
1. Preparation of qualification certificates, private documents, and preparation of qualification certificates and display of qualification certificates;
A. On November 16, 2016, the Defendant: (a) received a letter of delegation from the person who sent the foregoing name in the vicinity of the Guro-gu Seoul Metropolitan Government 1154 and subway 7, the Defendant: (b) obtained a letter of delegation from the person who sent the above name omitted; (c) on the same day, the name/business name of the F Bank heading branch located in Seongdong-gu Seoul, and moved to the F Bank heading branch; (d) “D” in the name/business name of the applicant; (e) “A” in the agent name column; and (e) the “A” and “A” in the agent name column; (c) affixed the seal impression of the F Bank heading branch in advance; and (d) submitted it to the employees of the F Bank heading branch in the said F Bank as if they were duly formed.
Accordingly, the defendant, in collusion with the name-based party, prepared a letter of application for transaction in the name of FF Bank in the name of D, a private document concerning rights and obligations, which is a private document, for the purpose of exercising the proxy qualification in collusion with D.
B. On November 18, 2016, the Defendant: (a) received a letter of delegation from the person who sent the foregoing name in the vicinity of the Guro-gu Seoul Metropolitan Government 1154 and subway 7, the Defendant: (b) obtained a letter of delegation from the Plaintiff; (c) on the same day, he/she moved to the F Bank No. Y branch of the F Bank located in Seodaemun-gu Seoul, Seodaemun-gu, Seoul; and (d) stated “A” in the name/corporate name column; and (c) indicated “A” and “A” in the name column of his/her agent’s personal information; (d) affixed his/her seal impression in the “A” column on the date of birth; and (e) affixed his/her seal impression in advance to the F Bank.
