1. The defendant shall be the plaintiff.

A. Of the area of 2,308 square meters in Namyang-si, each point is indicated in the attached Form 1, 2, 3, 4, and 1.

1. Determination as to the cause of claim

가. 인정 사실 원고는 2012. 9. 1. 피고와 남양주시 C 전 2,308㎡(이하 ‘이 사건 토지’라고 한다) 중 별지 도면 표시 1, 2, 3, 4, 1의 각 점을 차례로 연결한 선내 ㈎ 부분 200㎡ 지상 파이프구조 농막(에이동, 이하 ‘이 사건 농막’이라고 한다)을 보증금은 6,000,000원, 월 차임은 600,000원(차임 지급일 매월 5일 선불), 임대차기간은 2012. 9. 5.부터 2017. 12. 31.까지로 각각 정하여 임대하는 내용의 임대차계약(이하 ‘이 사건 임대차계약’이라고 한다)을 체결하고, 그 무렵 피고에게 위 농막을 인도하였다.

The defendant has established a mushroom spawn for growing mushroom in the above spawn zone (hereinafter referred to as the “instant spawn”), and cultivated the spawn.

The Defendant did not pay the Plaintiff the rent under the instant lease agreement after January 2013.

The sum of the rent that the Defendant had not paid from January 2013 to September 5, 2017 is KRW 18,60,000.

On September 29, 2017, a duplicate of the complaint of this case, stating that the Plaintiff terminated the instant lease agreement on the grounds that the Plaintiff was not paid two or more rents, was served on the Defendant.

B. According to the above facts, the Defendant, barring any special circumstance, removed the mushroom woods installed in the instant farmland, delivered the instant farmland and the instant land to the Plaintiff, and as for the rent of KRW 18,60,00, the total amount unpaid from January 2, 2013 to September 5, 2017, and the amount of KRW 18,60,000, each of which is subsequent to the delivery date of the copy of the instant complaint, calculated at the rate of 15% per annum under the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings from September 30, 2017 to the day of complete payment, as sought by the Plaintiff, and the delay damages calculated at the rate of 15% per annum from September 6, 2017 to the day of complete delivery of the instant land from September 6, 2017.
