1. The plaintiffs' claims against the defendants are all dismissed.
2. The costs of lawsuit are assessed against the plaintiffs.
Reasons
1. Facts of recognition;
A. The Plaintiff’s inheritance relationship 1) H was comprised of the two children of the Republic of Korea I and the South-North Korea J, and I had the Plaintiff B and the J as their respective children. 2) On April 9, 1959, upon the death of the said I and the J, H died on April 9, 1959. Pursuant to the former Civil Act, Plaintiff A inherited each of the instant shares of the Plaintiff B and C as 4/6 shares, and Plaintiff B and C inherited each of the instant shares of 1/6 shares.
B. 1) Division of each of the instant lands and the details of ownership transfer registration; H-owned Incheon-gun, Incheon-gun, 1775 square meters (hereinafter “instant land before division”).
(2) On April 1, 1995, the Plaintiff was divided into 1579 square meters for K, 1579 square meters for L, and 1579 square meters for the above K was divided into 403 square meters for K, 588 square meters for F, and 588 square meters for M, on January 17, 2005.2) Meanwhile, on the other hand, on the part of the land in this case before the division, the Plaintiff completed the registration of ownership transfer on August 20, 1963 with respect to the portion of 453 square meters for the donation on August 20, 1963, N on the portion of 61 percent for 175 square meters for sale and purchase on July 20, 195, and on the portion of 175 square meters for Defendant 14, 1981 for the special measures for the registration of ownership transfer on July 19, 195.
3) The letter of guarantee submitted under the Act on Special Measures at the time stated that Defendant D purchased the instant land from H on March 9, 1981, and the O, P, and Q, a guarantor, signed and sealed each guarantor column. 4) Defendant D completed the registration of transfer of ownership solely for the reason of the division of the jointly owned property on May 16, 2006, with respect to the remainder of the F.58 square meters divided on May 24, 2006. Defendant E completed the registration of transfer of ownership on April 25, 2008 by reason of sale on April 20, 2008, and thereafter F.58 square meters were divided into each of the instant land.
