1. The Defendant’s KRW 88,727,270 among the Plaintiff and KRW 81,130,132 among the Plaintiff and KRW 7,597,138 from November 30, 2013.
Reasons
1. Basic facts
A. The Plaintiff is a company running wedding business, resting restaurant business, etc., and the Defendant is an institution that manages the instant wedding hall facilities by being delegated by Seoul Mapo-gu Seoul Metropolitan Government with administrative affairs concerning the operation of wedding hall facilities located in B second floor (hereinafter “instant wedding hall facilities”).
B. On July 10, 2002, the Defendant entered into a contract with Defendant’s Intervenor to grant a loan for the term of the lease of the instant wedding facility from May 1, 2003 to April 30, 2013. The Defendant’s Intervenor agreed to change the term of the lease with Defendant from May 3, 2003 to May 2, 2013 during the period of operating the instant wedding facility after receiving delivery from the Defendant.
C. Meanwhile, on January 23, 2013, the expiration date of the loan period with the Defendant’s Intervenor, the Defendant publicly announced bidding for new selection of the operator of the instant wedding facility on January 23, 2013.
Accordingly, the Plaintiff participated in the said bidding on January 2013 and decided on February 4, 2013 as the first order to determine a successful tenderer, and was finally selected as a successful tenderer on February 14, 2013.
E. On February 25, 2013, the Plaintiff entered into a contract with the Defendant on the condition that the instant wedding facility be leased under the following conditions (hereinafter “instant loan agreement”). On March 25, 2013, the Plaintiff paid KRW 2,009,387,990 to the Defendant for the successful bid price.
