A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

[criminal records] On July 12, 2017, the Defendant was sentenced to a suspended sentence of two years for six months, due to a violation of the Act on the Punishment of Acts, such as the Mediation, etc. of Commercial Sex Acts, in the Support for Insan of Suwon Methods of Suwon, and the said judgment became final and conclusive on December 1, 2017.

[2] The Defendant, who is his father, committed a crime, committed an act of forging a written charter contract under Article 904-103 of the Jung-gu Seoul Metropolitan Government, Jung-gu, Seoul with his father, with the intention of raising a business fund as security for the deposit money.

1. On January 2016, the Defendant forged private document: (a) entered real estate indication, deposit, lessor, and lessee column on the lease contract for an apartment site that was downloaded via the Internet using a computer in the foregoing D Apartment No. 904-103, 103; (b) around that time, printed out it from the F office located in Gangdong-gu Seoul Metropolitan Government Gangdong-gu Seoul Metropolitan Government E; and (c) recorded “G” in the name column of the lessor, “H price G” in the name column of the lessor, and “G” in the name column of the certified broker, and affixed the seal of G and H created by the Defendant in advance on the side of each name column.

Accordingly, for the purpose of exercising, the Defendant forged one chapter of the lease contract on apartment in the name of H and G, which is a private document on rights and obligations.

2. On February 5, 2016, the Defendant: (a) delivered to I, who knew of the forgery at the coffee shop near the South Korean mountain railway station located in the vice-dong, Sungnam-si; (b) as if he was a document duly formed, the document of pre-sale of the forged apartment was used; and (c) exercised it.

3. The Defendant, at the time and at the place specified in Paragraph 2, presents a forged apartment lease agreement with the victim I as above, thereby offering the money as security and doing notarial acts by offering the money for lease on a deposit basis for apartment houses which live in and live in, now.

Interest shall be paid in three installments per month, and the principal shall be repaid until November 5, 2016.
