Defendant

A is the president of the K Market Merchants' Association in Changwon-si, the president of the Korea Market Federation in J, and Defendant B is the president of the L Market Merchants' Association in the same Dong, who is in charge of overall management, including the finance of each merchant's association. Defendant E and Defendant F are the members of the above K Market Merchants' Association, Defendant C and Defendant D are the members of the above L Market Merchants' Association.

On the same day, the Defendants, without undergoing the internal decision-making process, such as the resolution of the general assembly of the K market merchants or the consent of all the members, kept confidential the total amount of the development fund to other members, and distributed it only to the other members, and conspired to divide the Defendants and the Defendants into a large number of members.

Accordingly, the Defendants paid 7 million won to 11 of the total members of the above merchants' association, and one million won to 2 of the members of the above merchants' association for each distribution of development fund, and paid 22 million won for each of the Defendants' members R and S at will, and Defendant A paid 37 million won to 37 million won, Defendant E, and Defendant E.
