A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Around 08:00 on February 1, 2019, the Defendant was under the influence of alcohol with a 0.062% alcohol concentration of blood, and the Defendant driven B-low-income vehicle in the section of about 5km from the vicinity of the YYYYY, Gangnam-gu, Seoul to the south of the distribution intersection in Seoul, according to the distribution of Seocho-gu.

2. The defendant is in violation of the Act on Special Cases concerning the Settlement of Traffic Accidents (Bodily Injury).

On February 1, 2019, at around 08:00, the Defendant driven the said car while under the influence of alcohol of 0.062% as in the above paragraph (1) of this Article, and proceeded with the four-lane road of the distribution intersection south of Seocho-gu Seoul Metropolitan Government as in the distribution of Seocho-gu, Seoul.

In particular, since there is a central line, there was a duty of care to prevent accidents in advance by accurately manipulating steering steering devices, brakes, etc. in accordance with the central line, by safely driving along the right side of the central line, by driving the motor vehicle safely.

Nevertheless, the defendant neglected to perform the above duty of care while under the influence of alcohol and proceeded to the opposite side of the victim C(Nam, 69 years old) driving of the victim C(W5 years old) who was under the influence of alcohol to the opposite side of the defendant. The front part of the victim E(Nam, South, 38 years old) driving of the above SM5 vehicle continued to follow the above SM5 vehicle. The front part of the above PM5 vehicle's driving by the victim E(Seoul, 38 years old) was re-ted to the front part of the above PM5 vehicle's driving, and the above SM5 vehicle was pushed to the right side of the above 5-lane vehicle.
