Punishment of the crime

[Attachment] The Defendants conspired to acquire insurance money by deceiving the victim Matts Fire Insurance Co., Ltd., a comprehensive insurance company affiliated with the Defendant B, by setting fire to the AU Launa car owned by the Defendant B, and then deceiving another person to acquire insurance money as if the other person had caused a defect in the car.

【Criminal Facts】

1. Around 17:10 on February 18, 2015, Defendant B: (a) parked the said AU Launa car in the vicinity of the religious village to the coast of the captain of Busan-gun; and (b) delivered the gater and the gater oil to Defendant AS; and (c) Defendant AS destroyed the said car by setting the gater oil by putting it out to the seat, etc. of the said car.

Accordingly, the Defendants destroyed a motor vehicle of 16,830,000 won at the market price belonging to the ownership of Defendant B and caused public danger.

2. On February 18, 2015, Defendant B received a false insurance accident in accordance with the above conspiracy to the effect that, at around 22:00 on February 18, 2015, Defendant B received a false call from the Busan District Police Station located in Busan District, to the employees of the call center belonging to the victim Matts Fire & Marine Insurance Co., Ltd., which “I paid Don Don Don Ga AU Myststa car.”

However, the above car was destroyed by the defendants in collusion as above, and the loss incurred by the car was not the victim's claim for insurance money.

Ultimately, the Defendants conspired to induce the victim and receive insurance money from the victim with which the amount of money can not be known. However, the Defendants did not commit an attempted crime by cancelling the receipt of the insurance accident, which revealed the intention of the Defendants to intentionally set the said car by the black box installed in the said car.
