A defendant shall be punished by imprisonment for a maximum term of one year and six months, and a short term of one year.

Punishment of the crime

[2016 Highest 415] The Defendant, a violent organization, was a member of the “U.S. Northern wave,” and the Defendant was willing to take advantage of the fact that the middle and high school students knew of the Defendant as a member of the organized violence organization and did not refuse to comply with the Defendant’s request.

1. From May 2, 2015 to January 10, 2016, the Defendant demanded the victim C (the 17-year-old age) to lend money to the victim on the following occasions: around October 17, 2015; the Defendant stated that the victim was willing to refuse to lend money; and that “the victim was able to take frights, take frights, take frights, take frights, and bring frights, take money; and that 40,000 won in cash was deposited in the agricultural bank account (Account Number:D) in the name of the Defendant; and that between May 2, 2015 to January 10, 2016, the Defendant took the same method over KRW 1,209,000 in total over 25 times as indicated in the attached List 2-1 (1).

2. From May 7, 2015 to December 22, 2015, the Defendant demanded the victim E (the 17-year-old) to lend money to the victim on or below the inside time (the 17-year-old) and showed the attitude that the victim would refuse to do so, and, if the victim did not respond, the Defendant, who had organized violence, was issued KRW 400,000 from the victim with the delivery of KRW 400,000 from May 7, 2015 to December 22, 2015, took up the total of KRW 965,000 on 12 occasions, such as the list of crimes in attached Table 2-(2).

3. On December 16, 2015, the Defendant: (a) demanded that the “G cafeteria” located in the “G cafeteria F of the Mayang-si, Ansan-gu, Annyang-si, lend money to the victim H (the age of 17); and (b) seems to have the victim wanted to refuse the demand; and (c) the Defendant, who did not comply with the demand, will inflict any injury on the victim.
