A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant married in around April 2015 with the victim B(n, 33 years of age) and around 1999, but divorced around April 2015.

1. 상해 피고인은 2015. 10. 12. 08:40경 전남 해남군 C에 있는 피해자의 집에서, 피해자가 며칠간 자신의 전화를 받지 않았던 것에 대해 대화를 하고자 피해자에게 집 밖으로 나가자고 여러 차례 요구하였으나 피해자가 이를 계속 거부하자 화가 나 피해자의 손목을 강제로 잡아 마당으로 끌고 나오는 과정에서 피해자의 턱을 위 집의 시멘트 기둥에 찧게 하고, 주먹으로 피해자의 왼쪽 뺨 및 뒤통수를 수회 때렸다.

이후 피고인은 피해자가 자신을 피해 부근에 있는 교회 주차장으로 도망가자 피해자를 쫓아가 피해자의 머리를 움켜쥔 후 주먹으로 피해자의 얼굴을 수회 때리고, 피해자의 손목을 강제로 잡아끌고 가 자신의 차량에 태우려 하였으나 피해자가 강력히 저항하여 피해자를 차량에 태우지 못하자 피해자와 같이 집으로 돌아와 방안에서 손바닥으로 피해자의 뺨과 온몸을 수회 때려 피해자에게 약 2주간의 치료가 필요한 안면부, 경추부 등의 다발성 타박상 및 찰과상 등을 가하였다.

A special intimidation: (a) the Defendant assaulted the victim at the time and place set forth in paragraph 1 as above; and (b) threatened the victim with “the victim, who died of, and died from, today,” on the ground of virtual (17 mm in length), a dangerous object that was at the time and at the inside of the said house, during the dispute with the victim.
