A defendant shall be punished by imprisonment for not less than three months.
However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

Reasons
Punishment of the crime
On July 16, 2014, the Defendant filed a lawsuit claiming return of unjust enrichment (the instant case at the court 2014Da52430, Jun. 16, 2015) against the Defendant at Seosan Branch of the Daejeon District Court on the said land to return the unjust enrichment of KRW 49,366,710 on the rent corresponding to D’s co-ownership from the lessee’s share among the rent that the Defendant received from the lessee, and the said lawsuit was concluded on June 16, 2015.
1. From October 20 to July 7, 2015, the Defendant forged private document: (a) stated that “A (Defendant) and B (D) and C (F)” (the Defendant’s mother) shall enter into a lease agreement with G on behalf of A, D, and F on behalf of B and F on October 21, 2010 with respect to the land lease of 3,021 square meters prior to E in Siriri-si, E; and (b) entered into a lease agreement with B and 5 million won on behalf of B, D, and F on behalf of Siri-si, with respect to the lease of land of 3,021 square meters prior to E:

Therefore, “A” and “B” recognize that deposit 25 million won received from the said G and rents related to the said G transfer lease were deposited periodically in the head of the Tong with the mother’s support expense, litigation expense, etc., and that “A” and “B” recognize that the mother’s support expense ( hospital expenses, living expenses, etc.) was paid with monthly rent from the said G.
3. In addition, where the lease contract is terminated later, and the lessee G is required to return the deposit amount of KRW 25 million and his/her mother is required to accumulate and use part of his/her monthly rent in preparation for the expenses for supporting his/her mother, expenses for maintaining his/her management (such as specifications, cemeteries, graveyardss, etc.).
4. Since the monthly rent of Gap and Eul is 2.5 million won, Gap and Byung are divided into KRW 1.120,000,000 for 1.120,000 for D (B) and 5.60,000 for her mother.
