Reasons
Punishment of the crime
The defendant is a person who has been engaged in the management of gas stations in W located in Hanam-gun C as a member of the victim (state)B.
The Defendant, with the knowledge that the oil in the gas station is not transmitted to the gas station and that the record is not left by blocking all of the gas stations installed in the gas station (the oil and the amount being oil in the gas station, and the machinery indicating the balance of the oil), had the mind to embezzled the oil in the gas station owned by the victim (the gas station)B by blocking all of the oil tanks.
The Defendant, with all strings, sold oil to the cargo vehicles of E, F, G, H, I, J, K, L, and M using the above gas station, and solicited the Defendant to transfer part of the oil price to the Defendant. E, F, G, H, I, K, K, L, and M to transfer part of the oil price to the Defendant.
1. The Defendant conspired with E in collusion on July 2, 2010, embezzled the sum totaling KRW 22,954,80,000 at the market price of 32,80,000,000 via E’s cargo vehicle by having all sprinks left at the oil station at the above oil station, as shown in attached Table 1, from that time until June 18, 2013, as shown in attached Table 1, the Defendant embezzled the sum totaling KRW 22,954,00,00 in transit owned by the victim (state)B, who is in custody for business purposes, from that time to June 18, 2013.
2. Around May 9, 2009, the Defendant conspired with F in collusion with F, and embezzled an amount equivalent to KRW 4,537 liters at the market price of KRW 9,375,00,00 in total via F’s cargo vehicle at the above gas station, including a limited amount of KRW 500,00,000 at the market price of 339 liters via F’s cargo vehicle, from that time to June 22, 2013, as shown in attached Table 2, by the same method until June 22, 2013.
3. On January 20, 2010, the Defendant conspired with G in collusion with the foregoing, and attached Form 1,250,000 won at the market price of G transiting 848 liters via the cargo vehicle at the oil station at the oil station at the above station around January 20, 2010, including that of G.
