1. The Defendant’s KRW 2,440,171 as well as the Plaintiff’s KRW 5% per annum from December 22, 2015 to February 10, 2017, and the following.

1. Basic facts

A. On March 13, 2014, the Plaintiff established an Internet regular deposit account (1) at the Suwon Livestock Agricultural Co., Ltd., which shares the Defendant and CRM on March 13, 2014, “application for the use of agricultural e-financial services” (hereinafter “application of this case”).

(2) On March 3, 2001, the Plaintiff filed an application for Internet banking service by submitting a new application for Internet banking service. However, the Plaintiff was unable to use the Internet banking service due to long-term non-use. At the time, the Plaintiff stated the instant application in its phone number “B”, applied for the electronic financial fraud prevention service through the mobile phone SMS certification, and applied for the agricultural financial transaction basic terms and conditions (hereinafter “basic terms and conditions”).

(2) On March 14, 2014, the Plaintiff entered into a contract with the Defendant to deposit KRW 40,200,000 in an account with an authorized certificate of digital signature (attached Form 1) as indicated in [Attachment Form 1], and entered into a contract with the Defendant for deposit of KRW 40,20,000 in the account with an authorized certificate (hereinafter “instant deposit contract”) on May 20, 2014 (hereinafter “instant deposit contract”).

B. The Plaintiff’s mobile phone (B) around 16:00 on December 12, 2014, received the phone of the Plaintiff from the special investigation and staff of the Seoul Central District Public Prosecutor’s Office, and the name-free winners who misrepresented their inspection, and entered the address in the Internet address and connected site’s screen (hereinafter “Seoul Central Public Prosecutor’s Office homepage”).
