A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

To the extent that it does not harm the identity of the facts charged and the defendant's right to defense, part of the facts charged was revised and stated in accordance with evidence.

1. 특수 상해 피고인은 2018. 7. 7. 02:59 경 김포시 B에 있는 ‘C’ 식당에서 피해자 D(40 세) 과 술을 마시다가 말다툼을 하던 중 그곳 테이블 위에 있는 위험한 물건인 사기 그릇으로 피해자의 머리를 내리치고, 이에 피해 자가 바닥에 쓰러지자 위 사기 그릇으로 피해자의 머리를 수회 내리치고 발로 피해자의 몸을 차는 등 폭행하여 피해자에게 치료 일수 미상의 이마 왼쪽 부위, 왼쪽 귓바퀴, 뒤통수 왼쪽 부위가 찢어지는 상해를 가하였다.

2. The Defendant damaged the property by assaulting D as above by using the victim E-owned fraud fraud at the time and place described in the above paragraph (1).

3. The Defendant interfered with the business of the Defendant: (a) assaulted D at the time, place, as mentioned in the foregoing paragraph 1; and (b) collected a string, etc. on the table; and (c) interfered with the business of the restaurant operated by the victim E by force by having the customers get out of the restaurant.

4. Around 03:00 on July 7, 2018, the Defendant obstructed the performance of official duties, and the Defendant injured the Defendant: (a) committed assault to the places indicated in the above paragraph (1) above; (b) reported that there was an assault incident; (c) G, the police officer affiliated with the Kim Jong-chul, who was called up after having received a report of 112, sent out to the Defendant one time to check the circumstances of the instant case; (d) the victim H (33) who is the police officer affiliated with the same police box; and (e) committed assault to the victim, who is the police officer affiliated with the same police box, committed the assault, such as assaulting the victim for about two weeks of the cat requiring medical treatment.

Accordingly, the defendant interfered with the legitimate performance of duties by police officers in relation to 112 reporting management, and at the same time injured the victim.
