A defendant shall be punished by imprisonment for one year.

Punishment of the crime

1. On March 24, 2016, the Defendant: (a) driven a e-learning car without obtaining a driver’s license from around 500 meters in a section from around 200 meters to the front roads of D located in B, Dong-dong, Hanam-gun, Seoul, to the front roads in C; (b) on March 24, 2016.

2. On March 24, 2016, the Defendant driven a motor vehicle under the influence of alcohol by drinking alcohol, such as drinking alcohol, smelling it to the Defendant from a slope G affiliated with a slope branch of the police station located at the Hannam-dong Police Station, while driving the motor vehicle on the front of the said D on the road at around 21:35, 201.

Due to reasonable grounds, there was a demand for responding to the measurement of drinking in a manner that puts the breag into a drinking measuring instrument over about 30 minutes.

그럼에도 피고인은 음주 측정기에 입김을 불어 넣는 시늉만 하는 방법으로 이를 회피하여 정당한 사유 없이 경찰공무원의 음주 측정요구에 응하지 아니하였다.

3. On March 24, 2016, the Defendant: (a) around 22:06, on the road in front of the foregoing D, demanded the foregoing G to measure drinking and to produce a driver’s license; (b) but was arrested as a current offender and was transferred to the F police box located in the Hadong-gun C of the Gyeongnam-do.

At that place, the Defendant received a demand from the said G to reissue a driver’s license.

Accordingly, the defendant presented the first class ordinary driver's license of the defendant living in the name of the National Police Agency in Gyeongnam-nam, which is an official document in possession, as if the defendant was the driver's license of the defendant.

Accordingly, the defendant did not use official documents.

4. Forgery of private documents and the uttering of a falsified investigation document;

A. When the Defendant was required to place his signature and seal on the arrest confirmation certificate and the circumstantial statement report of the State driver at the above F box around the above day, the Defendant was “a person to confirm” of the above arrest confirmation letter and the Defendant’s signature and seal on the “name” column of the above State driver’s statement report, respectively.
