A defendant shall be punished by imprisonment for two years.

The defendant shall be ordered to complete the sexual assault treatment program for 40 hours.

Punishment of the crime

"2015 Gohap 586"

1. Around August 2015, the Defendant of quasi-raped the victim’s clothes of the victim C (V, 49 years of age) who has lost mind by drinking in a her mother telecom with which it is difficult to know the trade name in Yongcheon-si, Young-si, Mancheon-si, and sexual intercourse by inserting the victim’s sexual organ into the victim’s sound book one time.

Accordingly, the defendant has sexual intercourse with the victim by taking advantage of the victim's non-refluence condition.

2. On October 4, 2015, the Defendant damaged property: (a) at a mother telecom with which the trade name located in Bupyeong-gu Incheon Metropolitan City on October 4, 2015, the said victim left the cell phone on the floor and damaged KRW 1.40,00 won, such as liquid repair expenses, on the ground that the said victim used the cell phone without diving; and (b) the said victim used the cell phone.

3. On February 17, 2016, the Defendant intruded upon the victim C’s residence while living together with the Defendant located in Yongcheon-si D around 17, 2016 and six months.

4. Larceny;

A. From the date and time set forth in paragraph 3, the Defendant stolen the victim C’s possession with one modern card, which is the victim’s possession, one copy of the National Bank CC card, and one copy of the Daegu Bank transportation card at the time and place.

B. On February 17, 2016, the Defendant: (a) cut off total of KRW 3,500,000,000 by inserting the personal identification card of C, which was stolen, and then withdrawing cash, on five occasions, at a cash withdrawal period managed by a person with no knowledge of his/her name opened at a place from around 21:22 to 21:46 of that day; and (b) the Defendant’s personal identification number was entered.

On May 9, 2016, the Defendant stolen, with one cash 12,00 won, one resident registration certificate, one motor vehicle driver's license, one copy of a credit card of the national bank, and one other, which were located on the cash payment machine at the Yeongdeungpo-gu post office located in Yongcheon-ro 11, Youngcheon-si, 201.

5. The Defendant who damaged property from around 19:00 on May 4, 2016 to that month;

5. From 17:00 to 17:00, alcohol shall take place at the place described in paragraph 3.
