A defendant shall be punished by imprisonment for not less than one year and six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
On August 16, 2018, the Defendant was sentenced to 10 months of imprisonment with labor for a violation of the Specialized Credit Financial Business Act at the Seoul Central District Court and 2 years of suspended execution on August 24, 2018.
1. The Defendant established a false legal entity to the above B under the proposal that “A person shall pay 5% of the credit card sales amount deposited into the account if he establishes a legal entity and opens and transfers an account in his name,” and made a resolution to transfer the account to the Defendant after opening an account in his name.
Accordingly, around February 27, 2017, B submitted a false application for registration of incorporation to a public official in charge of the registration office of the Incheon District Court, located in 881, in the Incheon District Court, to a public official in charge of the registration office of the Incheon District Court, who is located in 881, without the intention of C to establish and operate a corporation normally, and had a public official in charge of the above registration office, who is aware of such fact, enter false facts in the special media records, such as electronic records, such as electronic records, which are the same as the original copy of the authentic deed, and made him/her store and operate the electronic records recorded in the above false facts, and exercised them from that time until July 5, 2017, as shown in the list of crimes (excluding No. 1 a year).
As a result, the Defendant reported false facts to the above public official B and recorded false facts in the special media records such as electronic records identical to the original of the authentic deed, and around that time, had him store and operate the public electronic records containing the above false facts.
