1. Details of the disposition;

A. On May 14, 1984, the Plaintiff was appointed as an annex kindergarten teacher to B elementary schools under the jurisdiction of the Gangwon-do Office of Education, and from March 1, 2017, the Plaintiff served as an assistant kindergarten attached to C elementary schools (hereinafter “instant kindergarten”) at C elementary schools (hereinafter “instant kindergarten”).

On October 12, 2017, the Plaintiff was indicted for the crime of causing damage to electronic records, etc., with the following contents in support of the Youngcheon District Court, and filed a request for formal trial, and was sentenced to a suspended sentence (a suspended sentence: a fine of two million won) in the above court on July 10, 2018.

On March 29, 2017, the Defendant, at the instant kindergarten around 11:00, destroyed the special media records, such as electronic records, by taking a handphone from the victim under the pretext of “I wish to report the victim’s children’s photograph,” and eliminating multiple recording files, such as a recording file, stored in a handphone, by taking the victim’s Handphone on the pretext of “I want to report the victim’s children’s photograph.”

The General Disciplinary Committee of Gangwon-do decided on September 20, 2018 on September 20, 2018 on the ground that the Plaintiff’s act of destruction and damage in this case constitutes a violation of Articles 56 (Duty of Fidelity) and 63 (Duty of Good Faith) of the State Public Officials Act, which constitutes grounds for disciplinary action under Article 78 (1) of the same Act.

On October 12, 2018, the Plaintiff filed a petition review with the Appeal Commission for Teachers seeking revocation of the instant disposition, but the said Committee dismissed the Plaintiff’s request on December 12, 2018.

Although an appeal was filed against the judgment of the court of appeal, the Chuncheon District Court rendered a judgment dismissing the appeal on May 24, 2019.

On May 29, 2019, the plaintiff filed a final appeal against this.
