Defendant shall be punished by a fine of KRW 2,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

1. Fraud;

A. On October 25, 2012, the Defendant posted a letter “sale of game IDs” on the Internet portal site Niber C bulletin board, at an unspecified place on October 25, 2012, the Defendant: (a) reported the said sales text to the Defendant; and (b) falsely reported the said sales text to the victim B who contacted the Defendant, as if he were to sell game IDs normally.

As such, the Defendant, by deceiving the victim, received money of KRW 50,000 from the victim who believed the Defendant’s horses to be true, through the bank account (D) in the name of the Defendant on the same day.

B. On October 14, 2013, the Defendant: (a) posted a letter on the Internet portal bulletin board “I will purchase an item” on the victim E at an unspecified place; (b) contacted the victim with the victim; and (c) falsified the game item as if I sell it normally.

As such, the Defendant, by deceiving the victim, received money of KRW 30,000,00 from the victim who believed the statement of the Defendant to be true, through an enterprise bank account (F) in the name of the Defendant on the same day, and acquired it by fraud.

2. Violation of the Establishment of Homeland Reserve Forces Act;

A. On July 5, 2012, the Defendant, as a member of the homeland reserve forces, failed to make a move-in report within 14 days from February 2012, 2012, not to deliver a notice of call-up for training to the reserve forces without justifiable grounds, while moving the place of residence from the Nam-gu Incheon Metropolitan City G and 301 to the Buddhist land as a member of the homeland reserve forces.

B. On May 28, 2013, the Defendant, as a member of the homeland reserve forces, failed to undergo the above training without justifiable grounds even when he received a notice of call-up for the homeland reserve forces training in the name of the Song-dong commander of the Song-dong, Song-dong, who was conducted at the Defendant’s home located in Songpa-gu, Seoul on May 14, 2013 through the training site on May 28, 2013, from the Defendant’s home located in Songpa-gu, Seoul on May 14, 2013.
