1. The Plaintiff:

A. Defendant B and Defendant C jointly share KRW 40,000,000 and as to this, Defendant B from April 2, 2018.

1. Facts recognized;

A. In relation to the parties, Defendant D is a licensed real estate agent running real estate brokerage business under the name of “E” (hereinafter “instant brokerage office”).

(2) Defendant D received KRW 600,000 per month from Defendant B and Defendant C, and lent its certificate of qualification or registration of its brokerage office to the said Defendants on April 22, 2017, and the said Defendants provided real estate brokerage services in the instant brokerage office from May 10, 2017 to February 20, 2018.

B. (1) On May 7, 2017, the Plaintiff entered into a lease agreement with Defendant C as the employee of the instant brokerage office (hereinafter “instant real estate”). On May 8, 2017, the Plaintiff transferred KRW 4,000,000 to the bank account under the name of the instant brokerage office. On May 18, 2017, the Plaintiff transferred the intermediate payment of KRW 26,240,000 to the said account. On May 21, 2017, the Plaintiff transferred the remainder of KRW 10,000,000 to the said account. On the same day, the Plaintiff: (a) deposited the instant real estate as the instant brokerage office; (b) deposited the remainder of KRW 10,00,000 to the said account; (c) deposited the instant real estate, lease deposit, KRW 40,000, KRW 00, KRW 1000, KRW 200, KRW 200, KRW 15,2017.

(2) At the time of the formation of the instant lease agreement, although Defendant B did not have been authorized by Defendant B’s F to the owner of the instant real estate, Defendant B and Defendant C introduced that Defendant B was the Plaintiff, and Defendant B was delegated by Defendant F’s son of the owner of the instant real estate, and prepared a real estate lease agreement regarding the instant real estate as an agent in F’s capacity, and the Plaintiff is a certified copy of the instant real estate register, a description verifying the object of brokerage, and a description.
