The defendant's appeal is dismissed.

1. Summary of grounds for appeal;

A. The Defendant did not forge or use a D’s career certificate under the name of an incorporated association E (hereinafter “this case’s career certificate”).

B. The sentence of the lower court’s unfair sentencing (the imprisonment of eight months, the suspension of the execution of two years, the community service time of 160 hours) is too unreasonable.

2. The following circumstances acknowledged by the court below based on the evidence duly adopted and examined by the court below as to the assertion of mistake of facts: ① the defendant operated (g)C with D, and C was entrusted by the Industry-Academic Cooperation Group of the former and operated a youth training facility called " Q". However, due to the change in bidding method, it was necessary to change the name of the representative of the operation of " Q" to D in order to participate in the bidding for the country under the name of (g)C; ② the defendant led the procedures for registration of change of the youth training facility, such as proposing the change in the name of the representative of the operation; ② the defendant visited the Korea Youth-gun Office on March 9, 201 and submitted an application for registration with D and F, as a representative; ③ At the time, the defendant was aware that the above requirement was not satisfied with D’s career requirement that “at least five years work experience from among the holders of the regular teacher qualification certificate, to be engaged in the youth training facility at the time of the request for the change in the name of the head of the Korea Youth.”

In light of the fact that the defendant can sufficiently recognize the fact that the defendant has forged and used the career certificate of this case as stated in the judgment below. Thus, this part of the defendant's assertion is without merit.
