For the same reason as the judgment of the court below, the court below reversed the judgment of the court of first instance which found the facts charged in this case guilty and sentenced not guilty. Examining the reasoning of the judgment below in light of the relevant legal principles and records, the court below did not err by exceeding the bounds of free evaluation of evidence against logical and empirical rules or by misapprehending the relevant legal principles. Accordingly, the court below’s decision to dismiss the appeal is so decided as per Disposition by the assent of all participating Justices on the bench.
