1. On June 29, 2016, the Defendant filed a claim for revocation of the removal of office No. 2016-283 between the Plaintiff and the Defendant Intervenor.
Reasons
I. Summary of this case
1. Details of decision on a petition for teacher;
A. Defendant Intervenor (hereinafter “ Intervenor”) is an educational foundation established pursuant to the Private School Act for the purpose of providing young children, elementary schools, secondary schools, and higher education.
B. On March 1, 2008, the Plaintiff was newly appointed as a sports, rehabilitation, and welfare course at C University as a full-time lecturer at C University, which was established and operated by the Intervenor, and served as an assistant professor on March 1, 2010, and on March 1, 2014, the Plaintiff was appointed as an associate professor, respectively.
C. Around December 2015, an intervenor received a petition on suspicion of corruption, such as the Plaintiff’s unfair receipt of research expenses and sexual indecent acts, and conducted an audit on the above suspicion from January 11, 2016 to January 28, 2016.
On February 4, 2016, the Intervenor requested the Teachers’ Disciplinary Committee of C University (hereinafter “instant Disciplinary Committee”) to make a disciplinary decision against the Plaintiff. On March 9, 2016, the said Disciplinary Committee made a disciplinary decision to dismiss the Plaintiff on the grounds delineated below.

From March 2013 to July 2014, by means of preparing and submitting a false research plan as if a new research was commenced even though the previous master’s degree paper was published, a total of KRW 14,700,000 for all four occasions as follows. This constitutes “an act of violating a teacher’s duty of performance” due to criminal fraud or occupational embezzlement, or unjust enrichment under the Civil Act and breach of a teacher’s duty and duty of good faith as a result of a teacher’s performance of duty.
