Reasons
Punishment of the crime
[Criminal Power] On December 5, 2012, the Defendant was sentenced to one year of imprisonment for fraud at the Seoul Western District Court, and the execution of the sentence was terminated on May 10, 2013 at the Seoul Southern Southern District Court.
【Criminal Facts】
After the Defendant became aware of the so-called “work loan” business operator who received a loan from a financial institution by forging documents, etc. through online site search, the Defendant conspiredd with C, D, etc., the above business operator, and the Defendant concluded the lease contract for the above apartment, even though the Defendant did not have concluded the lease contract for the apartment owned by E, and concluded the lease contract for the apartment and made a false payment for the lease deposit with the financial institution as if the lease deposit was paid.
1. On February 3, 2014, in collusion with C, D, etc., the Defendant: (a) at the G Licensed Real Estate Agent Office located in Yeongdeungpo-gu Seoul Metropolitan Government, the Defendant was the lessee; (b) the Defendant took place as if the lessee was the lessee; and (c) the said D, as if the lessor was the lessor, stated “Seoul Yeongdeungpo-gu H Apartment 201 Dong 602,” “Seoul Yeongdeungpo-gu H Apartment 201 Dong 602, Seoul, and the resident registration number column “I”, “J” in the resident registration number column, “J”, and “E” in the resident registration number column; and (d) sealed the E’s seal that he was aware of in advance on the back of the E’s name.
Accordingly, the defendant, in collusion with C, D, etc., forged one of the apartment lease contracts in the name of E, a private document on rights and obligations.
2. In collusion with C, D, etc. on February 4, 2014, the Defendant filed an application for a loan with the employee in charge of lending at the new bank inducement point located in Gyeyang-gu Seoul Metropolitan Government, Yeongdeungpo-gu, for the said forgery, and submitted and used the forged apartment lease contract as if it were duly formed, and as indicated below, forged twice from that time until February 12, 2014.
