A defendant shall be punished by imprisonment for six months.
Reasons
Punishment of the crime
On June 14, 2016, the Defendant was sentenced to four months of imprisonment with prison labor and one year of suspended execution for defamation in the Chuncheon District Court. The judgment became final and conclusive on August 24, 2018.
The Defendant and the Victim B’s husband C are in the past school students and third parties, and the above C was mediating between the Defendant and forest owners in purchasing forest land, and the Defendant was dissatisfied with the complaint on the ground that the price of forest land exceeds the market price.
Accordingly, the Defendant filed a lawsuit against C regarding “request for return of unjust enrichment,” but lost, and upon having filed a complaint against C with an investigative agency due to fraud, etc., it had been sentenced to defamation or insult against C and his wife.
1. Defluence;
A. On April 16, 2018, the Defendant: (a) carried out real estate brokerage business between April 16, 2018 and April 15:30, 2018, on the gate, wall and landscape of the victim B’s house located in Chuncheon City D; and (b) caused damage to the victim’s husband E to the real estate brokerage business; and (c) attached each posters stating “C and B frauds” to many unspecified persons.
B. On May 28, 2018, the Defendant: (a) around 16:50 on May 28, 2018, posted a banner on May 28, 2018, on the ground of the foregoing paragraph (1) and on the same ground, on the part from the top to the rear seat of the HH vehicle, the Defendant’s wife of the Defendant, on the ground of the foregoing paragraph (1) and (b) attached the banner stating that “a teacher who alters the nives of the nives into the nives of the nives of the nives of the Defendant, would also be the lives of

On May 31, 2018, the Defendant, at around 09:00 on May 31, 2018, attached a banner to the outside glass part of the I office outside the said G elementary school, wherein the said victim had been in office as a teacher, and attached the banner stating that “a teacher who alters the morale of South and North shall also be replaced by the third party.”
