A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
On August 2012, the Defendant: (a) opened and used a mobile phone in the name of C with the possession of the resident registration certificate of high school-friendly C, and (b) thought to receive money from a lending company in order to raise living expenses, etc.
1. A mobile phone opening;
A. On November 13, 2012, the Defendant violated the Resident Registration Act: (a) the Defendant opened a mobile phone in the name of “E” agency located in Busan Metropolitan City D and demanded an agent to present an identification card in the name of “E” agency; (b) the Defendant offered C’s resident registration certificate at his/her own discretion, and used C’s resident registration certificate unlawfully.
B. The Defendant forged a private document, or forged a private document, and exercised the forged application form in the name of C, which is a private document concerning rights and obligations, for the purpose of exercising his/her signature on the purchase column, using a tamp-shaped pen on the paper of the application form for accession kept there at the time and place specified in paragraph (1) of Article 1, and stating in the applicant column “C”, “C”, and “C” in the deposit note column, and issued the forged application form to the above agency employee who may be aware of the forgery as if it were a document duly formed.
2. Opening of a deposit account;

B. The Defendant forged a private document or uttering a private document under the name of C, which is a private document related to the rights and obligations, shall write “C” on the application form for the transaction kept there at the time and place specified in Article 2(a) and the document in which the Defendant entered “C” on the applicant’s name and affixes his signature thereto for the purpose of uttering.
