A defendant shall be punished by imprisonment for not less than one year and six months.

Evidence Nos. 1, 4 through 7, seized by the defendant, shall be confiscated, and 4.

Punishment of the crime

1. Despite the fact that the Defendant is not a person handling narcotics, etc., the Defendant treated the psychotropic drugs, as follows, Mebacule (i.e., a diaphone; hereinafter “philopon”). A.m., the Defendant handled the psychotropic drugs, as follows.

On September 2017, 2017, the Defendant: (a) around the summer-gu Seoul Central Francel, 2.8 million won, as the purchase price for phiphones, to C; and (b) around that time, 10g of plasticphones containing approximately 10g of philophones from the name Buddhist winners sent by C before D. D.

As a result, the Defendant purchased approximately 10 gramphones from C in KRW 2.8 million.

B. On September 2017, the Defendant provided C with one disposable injection machine containing approximately 0.2 grams in the guest rooms located in the number of 3 stories in Jung-gu Seoul, Jung-gu, Seoul, for free.

C. On July 22, 2018, the Defendant: (a) placed approximately 0.05g opphones in GUP car operated by the Defendant at the FF parking lot in Namyang-si, Gyeonggi-do, the Defendant’s residence; and (b) d) administered opphones by means of inserting approximately 0.05g opphones into a single-use injection machine, dilution with water; and (c) administering opphones to the Defendant’s arms.

On July 22, 2018, at around 19:28, when the Defendant kept the said Pacc car operated by the Defendant on the front road of Seongbuk-gu Seoul, the Defendant kept one plastic bag containing approximately 2.71g of philopon, one disposable injection device containing approximately 0.14g of philopon, and one disposable injection device containing approximately 0.13g of philopon.

Accordingly, the defendant possessed approximately 2.98 grams.

2. Any person who violates the Act on the Control of Narcotics, etc. (mariana) shall be prohibited from smoking marijuana, and no person other than a person handling narcotics shall deliver or receive marijuana;

The number of rooms of Eel three stories as described in paragraph C shall be non-filled marijuana from C.
