Reasons
Punishment of the crime
1. Around 16:10 on July 16, 2013, the Defendant was driving a mixed-type vehicle from the front side of the “Trest Officetel” to the front side of the convenience store of the “transport-type fishing” in Busan, the Defendant was under the influence of alcohol by 0.22% in a section of about 1km to the front side of the “transport-type fishing” convenience store.
2. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Death or Injury caused by Dangerous Driving) is a person engaging in driving a vehicle C.
On July 16, 2013, the Defendant driven the said car on July 16, 2010, and operated the three-lane in front of the convenience store of the "Maritime Fishing" in Busan, Daegu, Busan, along with one-lane from the border line to the Olympic intersection.
In such cases, a driver of a motor vehicle has a duty of care to prevent accidents in advance by safely driving the motor vehicle, such as making a change of the vehicle in line with the traffic situation of the front and rear left, accurately manipulating steering devices, brakes, etc.
