A defendant shall be punished by imprisonment for not more than ten months.
Reasons
Punishment of the crime
1. Fraud;
A. On December 27, 2018, from around 22:30 to around 0:00 on December 28, 2018, the Defendant ordered alcoholic beverages to the victim under the “D” entertainment drinking club operated by the victim C, which is located in Incheon City B, as the Defendant was a prosecutor who had no intent or ability to pay the price even if he/she was provided with alcoholic beverages, and thus, the Defendant was able to pay the price even if he/she is a high-priced quantity of alcoholic beverages.
The Defendant did not pay the sum of KRW 150,000, while he received from the victim, namely, the Scarblus one disease from the victim.
Accordingly, the defendant, by deceiving the victim, acquired economic benefits equivalent to the same amount.
B. On January 6, 2019, the Defendant: (a) around 00:30 on January 6, 2019, at the “G 1 room for entertainment drinking house” in the Victim F’s Operation in Seocheon-si; and (b) on fact, the Defendant was a violent criminal because the Defendant did not have an intent or ability to pay the price even if he was provided with alcoholic beverages or entertainment reception services; (c) was able to pay the price even if he was a high level of alcohol, and (d) demanded the victim to provide the service of entertainment reception workers
The Defendant did not pay the total amount of KRW 910,000, while he received 3 Scarblue Scarblus and entertainment reception service from the victim, that is, the Defendant did not pay the amount of KRW 910,000.
Accordingly, the defendant, by deceiving the victim, acquired economic benefits equivalent to the same amount.
2. On December 28, 2018, around 00:05, at the place indicated in paragraph 1(a) at around 00:05, the Defendant was the victim’s hand, who was unable to use the credit card to the victim who was requested by the victim C to settle the liquor price, and who was aware of “the change of other cards” from the victim who was unable to pay the liquor price with the said card, and the victim’s hand, who was the victim’s her hand, saying, “Doing year, whether he would have made the return for death, and would be the face of the card note.”
