A defendant shall be punished by imprisonment for three years.

An application for compensation by an applicant for compensation shall be dismissed.

Punishment of the crime

On December 23, 2011, the Defendant was sentenced to one year and three months from imprisonment due to a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes in the Daegu District Court Kimcheon-do, and completed the execution of the sentence on January 1, 2013.

1. Injury;

가. 피해자 D에 대한 상해 피고인은 2013. 4. 13. 21:50경 구미시 원평동에 있는 농협 구미지점 앞 도로에서 포터 화물차를 도로 가운데에 정차시켜 두고 있던 중, 그 뒤에서 승용차를 운전하던 피해자 D(39세)이 자신에게 상향등을 켜고 경적을 울렸다는 이유로, 피해자의 승용차를 따라가 피해자를 차에서 내리게 한 후, 피해자에게 “이 씨팔놈아, 왜 빵빵거리냐”라고 욕설을 하며, 피해자의 멱살을 잡아 흔들고 팔꿈치로 피해자의 코를 때린 후 피해자를 힘껏 밀어 위 승용차에 부딪히게 하여, 피해자에게 약 1주간의 치료가 필요한 목 부위의 표재성 손상 등을 가하였다.

B. On May 3, 2013, the Defendant injured the victim E: (a) around 11:37, 2013, the Victim E (n.e., 70 years of age) called “G” restaurant operated by the victim E (n.e., the victim: (b) but, (c) the victim said that “I am the n.e. the n.e. the n.e. the n.e. the n. the n.e. the n. the n.e. the n.e. the n. the n.e. the n.e. the n. the n.e. the n., the n.e. the n.e. the n., the n.e. the n., the n.e. the n., the n.e., the n.s.)”

Accordingly, at around 12:15 on the same day, the Defendant sought again to the above restaurant, and expressed the victim’s desire to read “the victim’s chests were pushed down with spow, dead, and sprinked with her fingers, she was frighted for about 14 seconds, she reported to the police, and she was only dead with her mother.” The Defendant again added the victim’s chests to the floor by her hand.
