Punishment of the crime
Defendant
A is the representative director of corporation B who imports and sells the golf products in Japan, and the defendant corporation B is a corporation whose main business is the import and export of golf products and wholesale and retail business.
1. Defendant A
(a) When it is intended to export, import or return goods, the name, standard, quantity and price of the relevant goods, and other matters prescribed by Presidential Decree shall be reported to the head of a customs office;
On July 14, 2012, the Defendant imported a total of KRW 47,153,694 won from the F&M company (P.M.J.), a business partner in Japan, for the purpose of sale, etc., the amount of KRW 15,00,00 (Korean Won 215,705 won) of Japan's import price of one-point golf club from Korea for the purpose of sale, etc., and was delivered as simple international mail, from that time to December 20, 2014, without filing a report thereon with the head of customs office on the aggregate of KRW 47,153,694 (Korean Won 215,705).
(b) When any person intends to export, import or return goods, he/she shall file a false declaration on the name, standard, quantity and price of the relevant goods and other matters prescribed by Presidential Decree with the head of a customs office and when he/she files a declaration, he/she shall not file a false declaration on the dutiable value
On February 10, 2011, the Defendant filed a report on the import of the golf club Hague 2 set forth in the name of F&M company B, a business partner in Japan (P.M.J.) and filed a report on the actual price of the goods with the said report reduced to 138,60,00, which is 113,40,000, and then evaded customs duties of 27,746 won, which is the difference (Korean Won 346,828 won) from 25,200, and then on January 12, 2015, the Defendant evaded customs duties of 27,746 won from 104 times by the same method as attached Table 2 of the Crimes List 2, such as 3,453 points for various golf equipment in Japan, and 128,724,862 won for the difference.
