피고인은 2012. 12. 16. 부산 사상구 소재 B대학교 공학관 앞 도로에서 피고인의 휴대전화기를 이용하여 피해자 C와 피해자 D이 서로 끌어안고 차에 기대어 있는 모습을 사진으로 촬영하여 피고인의 페이스북(facebook.com)에 ‘세상말세다ㅉㅉ 확대해서보셈여ㅡB대학교에서’라는 글과 함께 게시하고, 불특정 다수의 페이스북 이용자들이 1,470회 이를 열람하면서 남긴 ’어이없다‘, ’학교 망신 같다‘ 등의 댓글에 ’E님이랑 같이봤다ㅋㅋ 좋아서 정신을 못차리든대‘, ’맞음ㅋㅋㅋF앞‘, ’한바퀴돌고 왓을땐 차 뒷문 열어놓고 눕 ‘등 피해자들을 공개된 장소에서 애정행각을 벌이는 남녀로 비방할 목적으로 정보통신망을 통하여 공연하게 사실을 드러내어 다른 사람의 명예를 훼손한 것이다.
