1. Basic facts

A. The defendant is the council of occupants' representatives composed of the occupants of Seo-gu, Seo-gu, Gwangju (hereinafter "the apartment of this case"), and the plaintiff is the resident of the above apartment of this case.

B. On December 22, 2015, the election commission, which is the Defendant’s agency (hereinafter “instant election commission”), publicly announced that the election to be selected by the Defendant’s president and auditor (hereinafter “instant election”) will be implemented on December 30, 2015, and the Plaintiff and D were candidate for the president.

After that, in the election of this case, which came into force on December 30, 2015, the plaintiff was elected as the chairperson after obtaining 109 marks from the total valid valid 200 marks, and D from 91 marks.

C. On December 31, 2015, the instant election commission convened an emergency meeting around 10:30 on or before December 31, 2015, determined that the Plaintiff held an election campaign meeting on December 30, 2015, which was in violation of the provision on the restriction on election campaign in the election management regulations of the instant election commission (hereinafter “instant election management regulations”), and that the Plaintiff, in violation of the provision on the restriction on election campaign regulations of the instant election commission, participated directly in the meeting and claimed support from apartment residents on the same day, and was publicly announced to the effect that the notice of the result of the instant election is postponed in the name of the said election commission on the same day.

Around that time, the instant election commission sent a written request to the Plaintiff to vindicate the Plaintiff’s unlawful election campaign. Specifically, the Plaintiff requested the explanation to the effect that (i) the Plaintiff attended the meeting of senior citizens, such as E and F, a candidate for the chairperson on the election day of this case, and provided meals to the meeting of senior citizens as the members of the election commission; (ii) the Plaintiff immediately visited the polling station; and (iii) the Plaintiff solicited the Plaintiff to cast his vote to the Plaintiff during that period; and (iv) one is the occupant of the instant apartment.
