1. C in the election of the chairman of the council of occupants' representatives, which was held by the defendant in Seongdong-gu Seoul Metropolitan Government on September 18, 2015.

Basic Facts

On September 8, 2015, the election commission of the Defendant (hereinafter referred to as “election commission”) publicly announced the schedule for election of the chairman and auditor of the council of occupants’ representatives, and publicly announced that the Plaintiff and C were registered as candidates for the election of the chairman of the council of occupants’ representatives (hereinafter referred to as “instant election”) on September 18, 2015.

C was removed due to the absence of a long term of study during the four-year term of study in D University, the drama film, and the four-year term of study, and the election campaign materials, etc. stated the academic background called “the graduation from D University” (hereinafter “instant false entry”).

Accordingly, on September 16, 2015, the Plaintiff submitted a written request for deliberation to the above election commission to submit a certificate of graduation, etc. to the above election commission. The election commission decided to hold a meeting at around 16:30 on the same day to provide explanation to C in order to handle the Plaintiff’s objection, and the election commission requested C to attend a meeting at around 16:50 on the same day and present its opinion at the election commission at around 16:50 on the same day, but C did not answer that “A is an act to move in as a bad by election campaign, and is an act to pay for the time from the opposite party to the election, and is an act to pay for the time in good faith, and did not appear.”

Therefore, the Election Commission shall require C to submit explanatory materials by September 19, 2015, which is within three days pursuant to Article 16-2(3) of the Election Commission Regulations, to submit explanatory materials by September 19, 2015. However, the last day of the deadline shall be the relation as a legal holiday and shall be requested to submit explanatory materials by September 21, 2015, as publicly notified earlier, and the election of this case shall be held on September 18, 2015, and a meeting shall be held on September 17, 2015, which is the day of election, and the discussion on the academic issues raised by the Plaintiff and C shall be held on September 17, 2015, and the results shall be the same as the result may have a serious impact on the list of the voters.
