A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

[2013 Highest 1583] On December 20, 2012, the Defendant: (a) reported that the victim C purchases “PP” on the Internet NAV D website; and (b) made a false statement to the victim that “I will send PP if 90,000 won is remitted” to the victim.

However, there was no intention or ability to send the goods even if they receive money from the victim because they did not have the above goods.

As such, the Defendant, by deceiving the victim, received KRW 90,00 from the Korean bank account (Account Number:F) in the name of the Defendant’s mother E under the pretext of the purchase of goods from the victim.

In addition, the Defendant received a total of KRW 4,20,00 from around that time to January 26, 2013 by the same method four times as shown in the annexed crime list.

[2013 Highest 1724] On November 26, 2011, the Defendant sold “G” 3S 16,000 won on the website of Suwon-si, Suwon-si, and on the website of “G” using smartphones.

“Along with the writing, ” said that “Aphone 30,000 won is sent to the victim H (Nam, 31 years of age) who written up the writing and reported and contacted the writing,” and said, “Aphone 3S 16GB will be sent on a door-to-door basis.”

However, as such, there was no intention or ability to deliver the promised goods even if the said goods are transferred from the victim.

As such, the Defendant, by deceiving the victim, received 130,000 won from the victim as the mobile phone price on the same day, from that time until December 12, 201, and acquired 886,00 won in total on seven occasions, as shown in the attached crime inundation list by the same method from December 12, 201.

[2013 Highest 2047] On January 22, 2013, the Defendant reported to the victim that “I ambling a hot water boiler 50,000 won, including selective distribution,” posted by the victim I on the Internet Nene D camera bulletin board, and said I would sell the hot water boiler to KRW 50,000.”
