A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

Around May 9, 2020, the Defendant posted a false statement to the effect that “The Defendant will sell beerreconform turt on the Internet P bulletin board” on the website of Gangseo-gu Seoul Metropolitan Government (hereinafter referred to as Gangseo-gu) and that “the Defendant will send the money first to the victim H by sending it.”

However, in fact, the defendant did not have a sub-conform so that he did not have the intention or ability to deliver the sub-conform even if he received the payment from the victim.

Nevertheless, the Defendant, as such, by deceiving the victim, received KRW 1,300,000 from the victim to the Q account (R) in the name of the Defendant at around 10:49 on the same day as the sales proceeds of the bend joint container, and received KRW 1,30,000 from the victim from the victim, and received KRW 9,328,00 in total eight times from the victims, including transfer of KRW 9,328,00,00 in total, from the victims, for sale proceeds, such as transfer, sports, etc., by the same method from November of the same month.

Nevertheless, the Defendant, by deceiving the victim as such, received KRW 1,050,000 from the victim to the Qc account (R) in the name of the Defendant at around 19:48 of the same day under the pretext of the sales proceeds of the Nos. Mamath Pos Bab, and thereafter, received from the victim from the victim until November of the same month in the same manner.
