A Imprisonment for one year, and each of the defendants B shall be punished by imprisonment for eight months.

Punishment of the crime

Despite the fact that the Defendants are not persons handling narcotics, the Defendants dealt with the psychotropic drugs-related Mesofts (i.e., a single philopon; hereinafter “philopon”), as follows:

1. Defendant A

가. 피고인은 2019. 4. 14. 04:30경 휴대전화 채팅 어플리케이션인 ‘즐톡’을 통하여 만난 C과 함께 인천 남동구 D호텔 E호실에 투숙하였다.

At the above guest room, the Defendant added approximately 0.03 g of philophones into a single-use injection instrument, added them into water, injected them into the arms and administered them again, added approximately 0.02g of philophones into a single-use injection instrument, added them again into a water-dilution injection instrument, and then injected them into C’s dyposis in the next side.

Accordingly, the Defendant conspired with C to administer philophones.

B. On April 1, 2019, the Defendant: (a) inserted the volume of phiphones in a one-time injection machine of G Building H, the residence of which is located in Gangseo-gu Seoul Metropolitan Government F, into a single-time injection machine; (b) injected with water; and (c) administered phiphones in a way of injecting them with arms.

C. The Defendant around 06:00 on May 17, 2019

The G buildings H put about 0.05 g opphones into a single-use injection instrument, dilution with water, and medication of phiphones in a way of injection into the arms blood pipe. D.

Defendant around 13:30 on May 17, 2019

The G Building H sets up a disposable flag containing approximately 0.06 g of phiphonephones in the interior, and on the same day, around 13:35 of the same day, the G Building held it by means of inserting approximately 1.56 g of phiphones into the fingers kept in the 2nd floor parking lot of the G Building, which was parked in the 13:35 of the same day.

2. Defendant B: (a) around 06:00 on May 17, 2019, Defendant B-B.

The G Building H put approximately 0.05 g of philophones possessed by A into a single-use injection instrument, dilution with water, and then A administered philophones by means of having the Defendant injection into the Defendant’s arms blood cells.
