Reasons
Punishment of the crime
In calculating the price of the product, the Defendant used the fact that the employees of this care center have mainly applied the bar code attached to the product to pay a small amount of the product with the bar code of the low-priced product and used it to purchase the product.
On November 3, 2017, the Defendant: (a) attached the bar code of “HUKIG Art” equivalent to KRW 15,000 in the amount of KRW 15,00,00, the sales of which are prepared in advance to “HUTRAV cart” and presented as if the said products were to be “HORAV cart” to the employees in charge of calculating the name in a 17-day broad name.
However, the fact was that the Defendant’s bar code was attached to the “DUKIG main play sets” products.
Nevertheless, the defendant deceiving the above employees to settle 60,000 won, which is a total of 596,000 won in the market value, as above, the defendant paid 60,000 won in the amount of 60,000 won, and was issued by the above employees.
The Defendant, including that, through the same method from January 24, 2017 to November 3, 201 of the same year, acquired 188 “DUKIG main play sets” in total of 28,012,00 won from the market price from January 24, 2017 to November 3 of the same year.
