Punishment of the crime

The defendant is a person who has operated the Development Bank D in Seongdong-gu Seoul Metropolitan Government Co., Ltd.

In September 2012, the Defendant continued to operate the LAD, which no longer became capable of operating the LAD, and had no child support to the divorced pre-spouse, and had been urged to pay the existing debt, and had not been able to pay the cost of the goods, the Defendant was willing to immediately purchase the cattle from the victims and handle it in large volume with dumping, and then create cash by making it difficult for them to escape.

1. 피고인은 2012. 9. 3.경 서울 성동구 E에 있는 F시장 내에 있는 G에서, 기존 거래처였던 피해자 ㈜켐플러스의 직원 H에게 전화하여 “미국산 소고기를 납품해 주면 그 대금은 2012. 9. 14.까지 현금으로 결제해 주겠다.”라는 취지로 거짓말을 하였다.

On September 7, 2012, the Defendant made a false statement to the effect that “Around September 7, 2012, the Defendant would make a settlement in cash by not later than September 10, 2012, by phoneing to I of the victims of New Zealand Co., Ltd. to I of the victims of New Zealand Co., Ltd. to supply the victims of New Zealand Co., Ltd.”

However, as above, the Defendant did not have any intent or ability to pay the price even if he was supplied with a written accusation from the victim.

As such, the Defendant, by deceiving the victim, received from the victim the delivery of New Zealand cost equivalent to KRW 12,052,238 of the market price on the same day and acquired it by deception.
