A defendant shall be punished by imprisonment for not less than eight months.
Reasons
Punishment of the crime
1. "2014 Highest 1573";
A. However, in fact, the defendant did not have the intention or ability to find the birth of the victim in a car, and even though he knew that it is very uncertain that he would find the birth of the victim in a car through E, he did not notify the victim.
Accordingly, the Defendant, by deceiving the victim as above, received KRW 2 million in cash from the victim under his/her name as soon as possible, and continued to receive KRW 45 million in total from the agricultural bank passbook in the name of the Defendant on March 2, 2012.
B. Around May 31, 2013, the Defendant made a false statement that “Around May 31, 2013, the Defendant phoneed to the said victim at an influent place, and “I will complete payment after one week if I want to pay the money.”
However, even if the defendant borrowed money from the victim, he did not have the intention or ability to repay it.
Accordingly, the Defendant, by deceiving the victim as above, received 2 million won from the victim to the agricultural bank passbook in the name of the Defendant immediately.
2. On November 19, 2009, the Defendant of the 2014 Highest 3140, the Defendant would allow the victim J to continuously collect scrap metal generated from (oil), (oil), (oil)M, and (oil) I in H from two months after the payment of KRW 30,000 to K, for at least 150 tons per month at a limited company I office located in Yong-Nam Nam-gun, Yong-gun, Ha.
From 2 months after the domestic contract, it is difficult to collect scrap metal from K without mistake.
