Defendant shall be punished by a fine of KRW 20,000,000.
If the defendant does not pay the above fine, 50,000 won.
Reasons
Punishment of the crime
The Defendant is a Chinese national, who is engaged in trade business under the trade name, i.e., "C Limited Corporation" in 2401, 2401, and 401, Jung-gu, Busan Metropolitan City.
Any person who intends to engage in foreign exchange business shall prepare capital, facilities and professional human resources sufficient to conduct foreign exchange business and register in advance with the Minister of Strategy and Finance.
Nevertheless, on behalf of a person who wants to remit money from Korea to China, or a Chinese or a Chinese Korean business operator who wants to transfer money from China to Korea, the Defendant had been willing to engage in foreign exchange business without being registered with the Minister of Strategy and Finance by impairing or receiving money through the corporate bank account (E), the Nong Bank account in the name of D, the National Bank account in the name of G (H) and the National Bank account in the name of G (H).
On June 15, 200, the Defendant deposited KRW 1,200,000 in the corporate bank account (E) in the name of the Defendant from Seoul Buddhist District to China from the Republic of Korea on June 15, 2009, and deposited KRW 1,200,000 in the account under the name of the Defendant, and paid KRW 2,78,691,302 in total by using the said corporate bank account in the name of the Defendant’s name, KRW 52 times in total by using the said corporate bank account in the name of the Defendant’s name, KRW 140,411,401, and KRW 275,275,275 in the name of the Republic of Korea using the said bank account in the name of the Defendant, and KRW 2,786 in the name of the Defendant, KRW 2,78,691,302 in China, and KRW 52,41,401, and KRW 401 in the name of the said G.
In addition, around June 15, 2009, the Defendant was from a person whose name was not known at the Defendant’s office located in Jung-gu, Daejeon-si, Busan-si, 2401, 401, and 401, the Defendant’s KRW 1,200,000.
