Defendant shall be punished by a fine of KRW 5,000,000.
If the defendant does not pay the above fine, 100,000 won shall be one day.
Reasons
Punishment of the crime
1. The Defendant and the Defendant, together with B, conspired to acquire insurance proceeds by deception after intentionally causing a traffic accident. On August 13, 2008, around D 19:00, the Defendant received some of the D cafeteria in the vicinity of the D cafeteria located in Gangdong-gu Seoul Metropolitan Government (Seoul), and the Defendant received an insurance accident from the victim KB Non-Life Insurance Co., Ltd., and the Defendant and B received KRW 1,242,650 from the victim company as insurance proceeds.
2. The Defendant and F, G, H, and I’s joint criminal act with the Defendant and F, H, and I conspired to have the insurance money acquired after intentionally paying a traffic accident with H and I, and as a result, there is a concern that the occurrence of a traffic accident between each other would be easy to commit the crime. As such, G offered that it would take part in the above crime to F who are not aware of the other accomplices, thereby soliciting F to commit the above crime in order by accepting it.
G directed F to receive JM5 car from the Defendant and H on March 10, 2013, which: (a) around 20:30 on March 10, 2013, on the roads front of CGV dong in Gangdong-gu Seoul Metropolitan Government, and (b) on the roads front of the CGV dong in the BGV dong in Gangdong-gu, Seoul; (c) some of the said SM5 car was driven by K Otoba, and (d) received the insurance accident against the victim MV Fire Insurance Co., Ltd.; (b) Defendant G, F, H, and I received KRW 4,403,350 in total as insurance money from the victim company.
3. The Defendant and the Defendant jointly committed a traffic accident with I, L, M, N, andO: (a) conspired to receive insurance proceeds after intentionally paying the traffic accident with I, L, M, N, andO; (b) on the front side of Gangdong-gu Seoul Metropolitan Government P on January 20, 2014, the Defendant was driving Quaba I while driving L, M, N, andO on the front side of Quaba.
