Reasons
Punishment of the crime
[criminal records] On May 17, 2017, the Defendant was sentenced to a two-year suspended sentence of imprisonment for fraud at the Changwon District Court for eight months, and on October 24, 2017, the above judgment became final and conclusive. On August 23, 2017, the same court was sentenced to a two-year suspended sentence to six months of imprisonment for fraud, and the above judgment became final and conclusive on August 31, 2017.
[2017 Highest 2962] On January 14, 2017, the Defendant, using smartphones at the Defendant’s residence located in Sungwon-si E and 303, Sungwon-si, Changwon-si, 2017, posted a letter stating that “the cruise game account is sold” on the cruise bulletin board, and sent 60,000 won to the victim F who reported and contacted, will play a game account.

However, even if the defendant received money from the injured party, he did not have the intention or ability to sell the account.
Nevertheless, the defendant acquired 60,000 won from the victim's false statement to the NA bank account in the name of the defendant on the same day.
[2017 Highest 3203] On July 4, 2017, the Defendant made a false call to the victim G who puts up a notice on the national purchase bulletin “(2) of NAM DD4 19200” and sent KRW 120,00 to B’s account, and then sold two (2) computer RAM DD4 19200 if the Defendant transferred KRW 120,00 to B’s account.
However, the defendant did not have the intention or ability to sell the above goods to the victim.
As such, the Defendant, by deceiving the victim, received 120,000 won from the post office account (Account Number: H) in his/her name on the same day from the victim, from that time, from that time to July 17:29, 2017, including transfer of 120,000 won as the price for goods, and received a total of 480,000 won from five victims every five times as shown in the list of crimes in attached Table.
