A defendant shall be punished by imprisonment for one year.
Reasons
Punishment of the crime
1. Obstruction of business, damage to property;
A. On August 15, 2018, at around 08:00, the Defendant: (a) requested the victim C’s “D cafeteria” in the Mancheon-si B to change all of the owners in the Ma New Market; (b) on the ground that the victim was refused to do so; (c) the Defendant was able to avoid disturbance by cutting off the five soldiers of the amount equivalent to KRW 17,500, the market price of the victim’s ownership in the Mancheon-si; (d) cutting off the five soldiers on the floor; and (e) cutting off the 10 minutes of the market price.
As a result, the Defendant interfered with the victim's restaurant business by force, and at the same time damaged the property of 17,500 won owned by the victim.
B. At around 10:00 on August 15, 2018, the Defendant found a car at the above restaurant for the said reasons, and caused two customers, who had a disturbance during a period of up to 1 hour, such as 49,000 won in total and 14 diseases in total on the floor of the market value of the victim, which was the victim of the air conditioners, at the same time.
Accordingly, the Defendant interfered with the victim's restaurant business by force, and at the same time damaged the property equivalent to 49,000 won owned by the victim.
2. On August 15, 2018, the Defendant: (a) discovered at the “D cafeteria” as of August 16:10, 2018, and opened the entrance through which the victim C’s Dong E was unable to enter the cafeteria; (b) caused disturbance for about 30 minutes, including where the victim C was in front of the entrance.
Accordingly, the defendant interfered with the victim's restaurant business by force.
3. Violation of the Road Traffic Act (Refusal to measure a noise level) as a driver of a Fniniki vehicle, the Defendant was driving the Flukiki vehicle at around 16:10 on August 15, 2018 and led the vehicle to the said restaurant.
The Defendant, around 16:50 on August 15, 2018, was under investigation at the Hacheon-si Police Station G Hacheon-si’s Hacheon-si’s Hacheon-si, G, on the face of a bridge, with a view to unfolding a witness’s report and gathering, while investigating the suspicion of interference with his/her duties.
