A defendant shall be punished by imprisonment for six months.

However, the execution of the above sentence shall be suspended for a period of one year from the date this judgment becomes final and conclusive.

Punishment of the crime

1. No one shall distribute, sell, lease, or openly exhibit any obscene codes, text, sound, image, or motion picture via an information and communications network;

Nevertheless, on September 22, 2018, the Defendant posted obscene images 887 times in total as shown in the [Attachment Table 1] from around that time to June 16, 2019, on the Internet file sharing website, to Addd “C” (D”), and posted them as “E” by accessing the Internet file sharing website, so that many unspecified visitors can report and download them.

Accordingly, the Defendant distributed or displayed obscene videos to the public through information and communications networks.

2. No one shall distribute, sell, lease, or openly exhibit any obscene codes, text, sound, image, or motion picture via an information and communications network.

Nevertheless, on September 24, 2018, the Defendant posted obscene images on the Internet file sharing website (H) for a total of 663 times as shown in [Attachment List (2] from around that time to February 25, 2019, and made it possible for unspecified visitors to report and download the images by accessing the F site, which is an Internet file sharing site, to ID “G” (H), and by posting them as “I”. In addition, the Defendant made it possible for many unspecified visitors to report and download them.

Accordingly, the Defendant distributed or displayed obscene videos to the public through information and communications networks.
